Welcome to Elite Supply. These Terms of Service ("Terms") govern your access to and use of shopelitesupplyco.com and any purchase you make through it (the "Site"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you represent that you meet this requirement and that the payment information you provide is your own and is accurate.

3. Accounts

If you create an account, you are responsible for keeping your password confidential and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Products and Availability

We make every effort to display product colors, dimensions, and details accurately. Actual products may vary slightly from images due to photography, lighting, and your display settings. All products are subject to availability, and we may discontinue any product or limit quantities at any time.

5. Pricing and Errors

All prices are in U.S. dollars and are subject to change without notice. Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. If an item's correct price is higher than the listed price, we will contact you before shipping to ask whether you want to proceed at the correct price or cancel for a full refund. We reserve the right to correct errors and to cancel any order placed at an incorrect price, even after the order has been confirmed.

6. Order Acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not constitute acceptance. We reserve the right to refuse or cancel any order for any lawful reason, including suspected fraud, reseller activity, or unavailability. If we cancel your order, we will refund you in full.

7. Payment

Payment is processed securely by Shopify Payments and other authorized processors. We do not store your full payment card details. Applicable California sales tax is calculated at checkout.

8. Shipping, Returns, and Refunds

Our Shipping Policy and Refund Policy are incorporated into these Terms by reference. Please review them — they contain important information about delivery timeframes and your right to cancel or return an order.

9. Intended Use of Products

Our products are pet accessories, not veterinary or medical devices. They are not intended to diagnose, treat, cure, or prevent any condition in an animal. Always supervise your pet when using a new product, follow any manufacturer instructions included with the item, and consult a licensed veterinarian regarding your pet's health.

10. Acceptable Use

You agree not to use the Site to violate any law, infringe anyone's rights, transmit malicious code, interfere with the Site's operation, or access it through automated means without our written permission.

11. Intellectual Property

The Site and its content — including the Elite Supply name, logo, text, graphics, and layout — are owned by Elite Supply or its licensors and are protected by intellectual property laws. You may not copy, reproduce, or use them commercially without our written permission.

12. User Content

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our business. You represent that you own the content and that it does not violate anyone's rights. We may remove any content at our discretion.

14. Disclaimer of Warranties

Except where prohibited by law, the Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Elite Supply will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product purchased through it. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.

You agree to indemnify and hold harmless Elite Supply and its owner from any claim or demand, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party right.

17. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction. This does not prevent you from bringing a qualifying claim in small claims court.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

19. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page. Changes take effect when posted, and the Terms in effect at the time of your order govern that order. Please review this page periodically.
